The agreement between you and Electus LLC covering your use of ELECTUS, a human performance system.
Effective: August 7, 2026These Terms of Service form a binding agreement between you and Electus LLC, a limited liability company, covering your access to and use of the ELECTUS website, applications, and related services (the "service"). By creating an account, applying for or joining the beta, or otherwise using the service, you confirm that you have read and accept these terms. If you do not accept them, do not use the service.
You must be at least eighteen years old, or the age of majority where you live, to use ELECTUS.
ELECTUS is a human performance system. It provides structured mental preparation, performance-state, reflection and reset routines through a suite of products including E-PRIME, E-FLOW, E-DEVELOP and E-SHIFT, together with an algorithm that adapts to the inputs you give it over time.
The service generates written and interactive content in response to information you provide about your goals, your circumstances and the moments you are preparing for. It is a self-directed training and preparation tool, and nothing more.
ELECTUS is not a medical device, and it does not provide medical, psychological, psychiatric, therapeutic, diagnostic or treatment services. Nothing produced by the service is medical or mental-health advice, and no part of it is a substitute for professional care, diagnosis or treatment from a licensed physician, psychologist, therapist or other qualified provider.
If you are in crisis or believe you may be in danger of harming yourself or anyone else, stop using the service and contact your local emergency number or a crisis line immediately.
Never disregard professional advice, and never delay seeking it, because of something you read or experienced in ELECTUS. Do not use the service in place of treatment for any medical or psychological condition, and consult a qualified professional before making changes to any care you are receiving.
Any decision you make on the basis of the service is yours alone, and you accept full responsibility for it.
You are responsible for the accuracy of the information you give us, for keeping your login credentials confidential, and for all activity that takes place under your account. Tell us promptly at support@electusperformance.com if you believe your account has been accessed without your permission.
You may not share your account, sell access to it, or let anyone else use it. We may suspend or close an account that we reasonably believe is being used in breach of these terms.
You agree to use ELECTUS only for lawful purposes and only for your own performance. You agree not to:
Electus LLC's patent-pending technology and its nine proprietary claims filed with the USPTO, along with the ELECTUS name, wordmark and all software and design in the service, remain the property of Electus LLC. These terms grant you a limited, personal, non-exclusive, non-transferable and revocable licence to use the service, nothing more.
Content the service generates specifically for you in response to your inputs is yours to use. As between you and Electus LLC, and to the extent we hold any rights in it, we assign those rights to you and place no restriction on your using that output for your own personal or professional purposes.
You keep ownership of the information and material you put into the service. You grant us a licence to host, process, store and transmit your inputs and outputs so that we can operate and provide the service to you, and to use de-identified and aggregated data to improve the service.
You are responsible for what you choose to put in, and you should not enter information you are not free to share. Because the service uses generative and adaptive technology, similar inputs from different users can produce similar output, and we make no claim that the content generated for you is unique to you or that it can be protected as such.
Where the service offers community features, anything you post is your responsibility. You are solely accountable for the content, accuracy and legality of your posts, and you confirm that you have the right to share what you share. Do not post confidential information belonging to anyone else, do not post medical or professional advice, and do not post anything that breaks the acceptable use rules above.
By posting, you grant Electus LLC a non-exclusive, worldwide, royalty-free licence to host, display, reproduce and distribute that content within the service.
We do not endorse, verify or take responsibility for user posts, and we do not pre-screen them. We may remove any post, and suspend or terminate any account, at our discretion and without notice, but we are under no obligation to monitor community content and take no responsibility for content posted by other users or for your reliance on it.
The service is provided as is and as available, without warranty of any kind. To the fullest extent permitted by law, Electus LLC disclaims all warranties, express, implied or statutory, including the implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.
We do not warrant that the service will be uninterrupted, timely, secure, error-free or free of harmful components, that any defect will be corrected, or that the content generated will be accurate, complete, reliable or suitable for your circumstances. We make no promise or guarantee about any result, outcome, improvement in performance, or benefit of any kind from using ELECTUS. Any reliance you place on the service is at your own risk.
To the fullest extent permitted by law, Electus LLC and its members, officers, employees, contractors and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill, opportunity or anticipated savings, arising out of or connected with your use of or inability to use the service, whether the claim is in contract, tort, negligence, strict liability or any other theory, and whether or not we were advised that such damages were possible.
Our total aggregate liability for all claims relating to the service will not exceed the greater of the amount you paid Electus LLC in the twelve months before the event giving rise to the claim, or one hundred United States dollars.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so parts of this section may not apply to you, and in that case our liability is limited to the least extent permitted by law.
You agree to indemnify and hold Electus LLC harmless from any claim, loss, liability or expense, including reasonable legal fees, arising from your use of the service, your content, or your breach of these terms.
ELECTUS is currently offered as a beta. The beta is provided as is, free of charge or at a reduced rate, for evaluation and feedback. It may be incomplete, may contain defects, may behave unpredictably, and is not guaranteed to be reliable or continuously available.
We may add, change, suspend, limit or remove any feature, may change eligibility, pricing or access at any time, and may end the beta or the service entirely, in whole or in part, with or without notice. Data created during the beta may be reset, migrated or deleted, and you should keep your own copy of anything you want to preserve.
Feedback you send us is given voluntarily, and you grant Electus LLC an unrestricted, perpetual, royalty-free right to use it without obligation or compensation to you.
We may update these terms from time to time. When we do, we will revise the effective date at the top of this page, and where the changes are material we will make reasonable efforts to notify you. Continuing to use the service after the changes take effect means you accept the revised terms. If you do not accept them, stop using the service and close your account.
You may stop using ELECTUS and close your account at any time. We may suspend or terminate your access at any time, with or without cause and with or without notice, including if we reasonably believe you have breached these terms.
On termination, your licence to use the service ends immediately. The sections covering content ownership, no warranty, limitation of liability, indemnity, governing law and any other provision that by its nature should survive will survive termination.
These terms and any dispute arising out of them or out of your use of the service are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws rules. You and Electus LLC agree that the state and federal courts located in Delaware have exclusive jurisdiction over any such dispute, and you consent to personal jurisdiction and venue there. Nothing in this section prevents either party from seeking injunctive relief in any court of competent jurisdiction to protect its intellectual property.
If any provision of these terms is held unenforceable, the rest remains in force, and the unenforceable provision is limited to the minimum extent necessary. Our failure to enforce a provision is not a waiver of it. These terms are the entire agreement between you and Electus LLC regarding the service. You may not assign them; we may assign them in connection with a merger, acquisition or sale of assets.
